Use Viqtory Responsibly

1. Agreement to These Terms

These Terms of Service govern your access to and use of Viqtory Stats, including our website, mobile applications, subscriptions, analytics, content, tools, charts, account features, VIP access codes, and related services. By creating an account, purchasing a subscription, redeeming an access code, downloading the app, or using the service, you agree to these Terms.

If you do not agree, do not use Viqtory Stats. If you use the service on behalf of a company, organization, or other person, you represent that you have authority to bind them to these Terms.

2. Eligibility and Account Security

You must be at least 13 years old to use Viqtory Stats. You must be at least the legal age required in your jurisdiction to view or use any sports betting related analysis, odds, wagering-adjacent content, or market intelligence features. You are responsible for complying with all laws that apply to you.

You are responsible for your login credentials, account activity, email verification, and any device used to access your account. Tell us promptly if you believe your account has been compromised. We may refuse, suspend, or terminate accounts that violate these Terms or create legal, security, fraud, payment, or operational risk.

3. Informational Use Only

Viqtory Stats provides sports information, analytics, predictions, projections, odds-adjacent analysis, fantasy tools, charting tools, player information, team information, schedules, news, and related content for informational and entertainment purposes only.

Viqtory Stats does not provide financial advice, legal advice, tax advice, gambling advice, or investment advice. Viqtory Stats is not a sportsbook, casino, bookmaker, fantasy contest operator, exchange, broker, financial institution, or wagering platform. We do not accept wagers, hold customer betting funds, set betting lines for sportsbooks, process bets, or guarantee winnings.

Sports outcomes are uncertain. Data may be delayed, incomplete, inaccurate, unavailable, or changed by third-party sources. You are solely responsible for any decision you make based on the service.

4. Subscriptions, Billing, and Refunds

Paid access may be offered through monthly, yearly, trial, promotional, VIP, or other plans. Subscription billing, checkout, taxes, receipts, renewals, cancellation controls, and payment processing may be handled by RevenueCat, Apple, Google, Stripe, Paddle, app stores, payment processors, or other third-party providers.

Prices, plan names, features, and billing periods may change. Unless otherwise stated at checkout, subscriptions renew automatically until canceled. You are responsible for canceling before renewal if you do not want to be charged again.

Refunds are not guaranteed and may be controlled by the app store, payment provider, or billing platform used for your purchase. We may, but are not required to, provide credits, refunds, extensions, or accommodations.

5. VIP Access Codes and Promotions

VIP access codes, promo codes, discounts, trials, complimentary access, and lifetime access offers are discretionary. They may be limited to one use, one account, a specific recipient email, a specific term, a specific tier, or other conditions we set.

We may revoke, deactivate, refuse, or limit an access code or promotional benefit if we believe it was shared improperly, resold, abused, generated by mistake, used fraudulently, or used in a way that harms Viqtory Stats or other users.

6. Acceptable Use

You may not misuse Viqtory Stats. Prohibited conduct includes scraping, copying, reselling, sublicensing, reverse engineering, bypassing access controls, sharing paid accounts, abusing promo codes, attacking our systems, introducing malware, impersonating others, violating law, infringing rights, harassing users, or using automated systems without written permission.

You may not use Viqtory Stats to operate a competing data service, betting service, fantasy service, analytics product, model-training dataset, or commercial product without our written permission.

7. User Content and Chart Creator

If you create, upload, save, export, share, or submit content through Viqtory Stats, including charts, images, text, usernames, profile data, comments, dashboards, or other materials, you represent that you have the rights needed to do so.

You keep ownership of your original user content, but you grant Viqtory Stats a worldwide, non-exclusive, royalty-free license to host, store, process, display, modify for formatting, reproduce, distribute, and use that content to operate, improve, protect, and promote the service. You are responsible for any content you create or share.

8. Intellectual Property

Viqtory Stats, Viqtory, our logos, designs, software, interfaces, analytics presentation, charts, copy, visual style, systems, and other proprietary materials are owned by us or our licensors. Except for the limited right to use the service under these Terms, no rights are transferred to you.

You may not remove copyright, trademark, attribution, watermark, or proprietary notices from any service content unless we expressly allow it.

9. Third-Party Services and Data

Viqtory Stats may depend on third-party platforms, data providers, APIs, app stores, payment processors, analytics tools, content sources, sports data sources, cloud providers, AI systems, and embedded services. We are not responsible for third-party services, outages, policies, content, prices, data errors, or decisions.

Third-party terms may also apply to your use of their services. If third-party data changes, becomes unavailable, or contains errors, parts of Viqtory Stats may be delayed, limited, incorrect, or unavailable.

10. Privacy and Communications

We may collect and process account information, profile information, device information, usage information, purchase status, support messages, verification data, and other information needed to operate, secure, personalize, improve, and bill for Viqtory Stats.

By creating an account, you consent to receiving service emails, verification emails, billing emails, security messages, support messages, and important account notices. Marketing communications, if any, may include opt-out controls where required by law.

11. No Warranties

Viqtory Stats is provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of accuracy, availability, reliability, merchantability, fitness for a particular purpose, title, and non-infringement.

We do not guarantee that the service will be uninterrupted, secure, profitable, error-free, or suitable for any particular decision, contest, wager, lineup, investment, business, or outcome.

12. Limitation of Liability

To the fullest extent allowed by law, Viqtory Stats and its owners, employees, contractors, affiliates, service providers, and licensors will not be liable for indirect, incidental, consequential, special, exemplary, punitive, lost profit, lost revenue, lost data, lost opportunity, wagering loss, fantasy contest loss, or business interruption damages.

To the fullest extent allowed by law, our total liability for any claim will not exceed the greater of the amount you paid to Viqtory Stats for the service in the three months before the claim arose or one hundred U.S. dollars.

13. Indemnification

You agree to defend, indemnify, and hold harmless Viqtory Stats and its owners, employees, contractors, affiliates, service providers, and licensors from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorney fees, arising from your use of the service, your content, your violation of these Terms, your violation of law, or your infringement of another party's rights.

14. Suspension and Termination

We may suspend, restrict, or terminate your access at any time if we believe you violated these Terms, created risk, misused the service, failed to pay, abused access codes, violated law, or harmed Viqtory Stats, other users, or third parties.

You may stop using the service at any time. Canceling a subscription may require action through the app store, RevenueCat, payment provider, or account where you purchased.

15. Dispute Resolution, Arbitration, and Class Waiver

Before filing a claim, you agree to first contact us and try to resolve the issue informally. If a dispute cannot be resolved informally, you and Viqtory Stats agree to resolve disputes through binding individual arbitration, except where prohibited by law or where a claim qualifies for small claims court.

You and Viqtory Stats waive the right to participate in class actions, class arbitrations, representative actions, private attorney general actions, and jury trials to the fullest extent allowed by law. Claims must be brought individually.

You may opt out of arbitration within 30 days after first accepting these Terms by emailing support@viqtorystats.io with the subject "Arbitration Opt Out" and the email address tied to your account.

16. Governing Law

These Terms are governed by the laws of the State of Nevada and applicable U.S. federal law, without regard to conflict of law rules, unless your local law requires otherwise. Venue for any court proceeding not subject to arbitration will be in state or federal courts located in Clark County, Nevada, unless prohibited by law.

17. Changes to These Terms

We may update these Terms from time to time. The updated version will be effective when posted unless a later date is stated. Continued use of Viqtory Stats after changes become effective means you accept the updated Terms.
